Bella Yacht (SAS BELLAYACHT, capital €10,000, RCS Cannes 850 144 205) is an independent boutique yacht brokerage based in Cannes, France, specializing in the acquisition, sale, buyer representation, and refit advisory for luxury motor and sailing yachts in the Mediterranean and worldwide.

These Terms and Conditions govern your access to and use of bellayacht.com and our professional brokerage services. By browsing this website or engaging our services, you agree to be bound by these terms in full.

2. Brokerage Services & Accuracy of Information

2.1 Brokerage Services

Bella Yacht acts as an independent intermediary between buyers and sellers of pre-owned luxury yachts. Our services include:

• Yacht listing, presentation, and global marketing.
• Bespoke buyer-side search mandates (Yacht Acquisition Club).
• Purchase representation, negotiation, and closing advisory (Buyer's Broker Service).
• Coordination of independent marine surveys, haul-out inspections, and sea trials.
• Transaction facilitation, escrow coordination, and title transfer assistance.

2.2 Accuracy of Listings

All yacht specifications, measurements, capacities, and pricing are displayed in good faith based on data provided by sellers, builders, and verified database feeds (YATCO BOSS). While we strive for absolute accuracy, listings are provided subject to prior sale, price revisions, or typographical errors without notice.

3. Buyer Responsibilities

Prospective purchasers agree to:

• Commission a comprehensive marine survey by a certified independent marine surveyor.
• Conduct an operational sea trial prior to formal vessel acceptance.
• Verify title deeds, VAT payment evidence, flag registration requirements, and maritime encumbrances.
• Comply with international Anti-Money Laundering (AML) regulations and provide verified source-of-funds documentation.

4. Seller Responsibilities

Owners listing vessels through Bella Yacht agree to:

• Provide truthful, complete, and accurate information regarding vessel condition, maintenance history, and equipment.
• Disclose any known defects, previous casualties, liens, mortgages, or legal claims against the vessel.
• Grant reasonable access for viewings, inspections, surveys, and sea trials by qualified buyers.

5. Commissions & Fees

Brokerage commissions and performance fees are established in separate written brokerage agreements (central agency mandates, retained buyer briefs, or standard MYBA/YATCO co-brokerage rules). Ancillary expenses (e.g. surveyor fees, haul-out charges, sea trial fuel, flag registration dues) remain the buyer's or seller's responsibility as agreed in contract.

6. Limitation of Liability

Bella Yacht acts strictly as an intermediary broker. We are not liable for latent defects, seaworthiness, manufacturer warranties, or disputes between buyers and sellers. To the fullest extent permitted by French law, Bella Yacht’s total liability for any claim shall not exceed the net brokerage commission received on the relevant transaction.

7. Intellectual Property & Data Protection

All content on bellayacht.com (texts, photography, branding, database listings) is protected by intellectual property law. Unauthorized automated scraping, reproduction, or commercial re-use is strictly prohibited. Personal information is processed in accordance with our Privacy Policy.

8. Governing Law & Jurisdiction

These Terms and Conditions are governed by French law. Any dispute arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent courts of Cannes / Grasse, France.
